Hospital to appeal over damages

A Nottinghamshire hospital has won the right to appeal against compensation of £230,000 awarded to a patient.

Dorothy Cardno, from Mansfield, fell 30 feet (9.1m) from a balcony at Kingsmill Hospital in the town five years ago.

Mrs Cardno broke her back and legs. She has to use a wheelchair when she leaves the house and is in constant pain.

But on Tuesday the hospital was allowed an appeal hearing after its barrister described the accident as "wholly unforeseeable".

Dorothy Cardno, who had been admitted to hospital after a suspected heart attack, fell off the balcony at Ward 3 of Kings Mill Hospital in March 2003.

In February, Judge Richard O'Rorke awarded £230,000 damages against the Sherwood Forest Hospitals NHS Trust after ruling the gap in the balcony was unsafe.
